1. General provisions and definitions

This document is a public offer to conclude a retail sale agreement on the terms set out below, under Articles 633, 641 and 642 of the Civil Code of Ukraine.

Placing an order on the site constitutes full and unconditional acceptance of this offer. The agreement is concluded at that moment.

  • Seller — an individual entrepreneur (ФОП) acting on the basis of an extract from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Formations.
  • Buyer — a legally capable natural person who has placed an order on the Site.
  • Site — the online store at https://www.kian.com.ua.
  • Goods — clothing and related products presented on the Site.
  • Order — a duly completed request by the Buyer to purchase Goods.

2. Subject of the agreement

The Seller undertakes to transfer the Goods into the Buyer's ownership, and the Buyer to accept the Goods and pay their price on the terms of this agreement.

Images of the Goods on the Site are illustrative. A shade on screen may differ from the actual colour because of display settings; this is not a defect.

3. Placing an order

Orders are placed through the form on the Site. The Buyer provides a surname and first name, telephone number, email address, and the method and place of delivery.

The Buyer is responsible for the accuracy of the data provided. An order that cannot be delivered because of an error in that data is returned to the Seller, and the carriage costs are borne by the Buyer.

The Seller may decline to confirm an order where the Goods are unavailable, the data is plainly inaccurate, or the order shows signs of abuse. Any sums paid are refunded in full.

4. Price and settlement

Prices are stated in hryvnia. The Seller may change prices; the price of an order is fixed at the moment it is placed and later changes do not apply to it.

Payment is made either in full by payment card through a payment service, or as a partial prepayment with the balance paid on receipt. A prepayment counts towards the price of the order.

Card details are entered by the Buyer on the payment service's side. The Seller does not receive, process or store them.

5. Delivery

Delivery is carried out by the Nova Poshta carrier on the carrier's terms and at the carrier's rates. Delivery times announced by the carrier are indicative; the Seller is not liable for their breach through the carrier's fault.

The risk of accidental damage or loss passes to the Buyer when the Goods are handed to the carrier.

6. Rights and obligations of the parties

The Seller shall transfer Goods of proper quality, complete and on time; provide accurate information about the Goods; and process personal data in accordance with the Privacy Policy.

The Seller may change the range, prices and terms of this offer unilaterally; changes take effect on publication on the Site and do not apply to orders already placed.

The Buyer shall provide accurate data and pay for and accept the Goods.

The Buyer may exchange and return Goods as provided by applicable law and by clause 7 of this agreement.

7. Return of goods and refunds

The Buyer may exchange or return Goods of proper quality within 14 days of receipt, provided the Goods have not been used and have retained their saleable condition, consumer properties and factory labels, and provided proof of purchase is available (Article 9 of Ukraine's Consumer Rights Protection Act).

Exchange and return do not apply to goods included in the List approved by Resolution No. 172 of the Cabinet of Ministers of Ukraine of 19 March 1994.

Refunds are made by the same means as the payment, within the period established by law, after the Seller has received and inspected the Goods.

Where a defect is found, the Buyer exercises the rights provided by Article 8 of Ukraine's Consumer Rights Protection Act.

8. Liability

The parties are liable in accordance with the applicable law of Ukraine.

The Seller is not liable for the Buyer's improper use of the Goods, nor for damage caused by failure to follow the care instructions on the label.

9. Force majeure

The parties are released from liability for non-performance caused by circumstances of insuperable force, including military action, armed aggression, the introduction of martial law, destruction of infrastructure, emergency power outages, acts of public authorities and natural disasters.

10. Term

The agreement takes effect on acceptance and remains in force until the parties have performed their obligations in full. This offer is effective from its publication on the Site until withdrawn by the Seller.

11. Seller's details
